Term Notes: Under the new law a patent has a term of 20 years from the date of filing. A short term so-called consensual patent is also available (granted without examination) and has a term of 10 years from the date of filing.

Country Notes: The State Patent Office (SPO) of the Republic of Croatia was established on December 31, 1991, only shortly after Croatia declared its independence (October 11, 1991).

07/04/2004 UPDATE: For filling after  1 April 2004 the protection conferred by European patent application and patents can be extended to Croatia without any subsequent examination. The European patents extended to Croatia will have the same effect as the national patents granted in Croatia.

Law Notes: The preparation of new legislation concerning industrial property in Croatia, at present, is at a very progressive stage. Separated laws on patents, trademarks and designs are in the last phase of preparation before adoption. 

This new legislation is fully harmonized with most recent developments of international jurisprudence in this field (PLT, TLT, GATT-TRIPs Agreement etc.) According to both the Industrial Property Law which is in force, and the new legislation draft, foreign companies can protect or maintain the rights of industrial property by direct filing in the Republic of Croatia (and Bosnia-Herzegovina) only by mediation of registered representatives
